By entering and using the website, use of any services including subscription/s, purchase of any products and engaging with us on internal and/or external platforms, you agree to be bound by these terms and conditions and our privacy policy and code of conduct. In these terms and conditions, the words "website, services, products, engagement" refer to the Disability Compliance Aust. Pty Ltd website, services, products, engagement "we", "us", "our" and “Disability Compliance Aust. Pty Ltd” refer to Disability Compliance Aust. Pty Ltd and "you" “client” and “user/s or service user/s" refer to you, the Disability Compliance Aust. Pty Ltd user. The following terms and conditions apply to the website, subscription, services, products, and engagement offered by Disability Compliance Aust. Pty Ltd. This includes the mobile and tablet versions as well as any other version of Disability Compliance Aust. Pty Ltd accessible via desktop, mobile, tablet, social media, or other devices.

 

  1. ACCEPTANCE OF TERMS

    This agreement sets forth legally binding terms for your use of Disability Compliance Aust. Pty Ltd. By using the website, subscription, services, products, and engagement, you agree to be bound by this agreement. If you do not agree to the terms of this agreement, you must NOT use the website, services, subscription, products, or engagement. We may modify this Agreement from time to time, and such modification shall be effective upon posting on Disability Compliance Aust. Pty Ltd website. You agree to be bound by any modifications to these terms and conditions when you use the website, services, subscription, products, and engagement offered by Disability Compliance Aust. Pty Ltd after such modification is posted on the website; therefore, it is important that you review this Agreement regularly. Access to the website and use of the website, services, products, subscription, and engagement are available to people over the age of 18 years old. It is the responsibility of parents and legal guardians to determine whether any of the content, products, subscription, and services offered on the website are appropriate for their children or minors under their guardianship or under 18 years old age. Pty Ltd may, in its sole discretion, refuse to offer the website, services, subscription, products, and engagement to any entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the website, services, products, subscription, and engagement is revoked in such jurisdictions. The website, services, subscription, products, and engagement may only be used in compliance with these terms and all applicable local, state, national and international laws, rules and regulations. By using the website, services, subscription, products, and engagement, you represent and warrant that you have the full right, power and authority to enter into this agreement and to fully perform all of your obligations hereunder. You further represent and warrant that you are under no legal disability or contractual restriction that prevents you from entering into this agreement.

    As a client and/or service user of Disability Compliance Aust. Pty Ltd you agree and accept that your email address, telephone/mobile number, and other personal information will be collected. You agree that we may use your details to send you important notifications and communications about our website, services, subscription, products, and engagement, news and special content. If you do not wish to receive these emails, you may opt-out of receiving them by sending us your request through our contact information or by using the "unsubscribe" option in the emails. Opting out may prevent you from receiving emails regarding our website, services, subscription, products, and engagement, important news, and special content.

     

  3. SERVICES

    Through practical, time-efficient, and affordable advice, coaching, mentoring, information, support, resources, training, tools and templates Disability Compliance Aust. Pty Ltd supports ndis and disability sole traders, unregistered & registered providers with Disability Business Start-Up, NDIS Registration, Renewal & Auditing, Service Management & Delivery Support, NDIS Commission Compliance, Compliance Prompting, Strategic and Business Planning, Consultation Support, Marketing & Advertising, Internal & External Professional Development and Resources & Templates and more. Disability Compliance Aust. Pty Ltd offers the following services but not limited to:

     

    1. Support, systems and solutions centre that simplifies and supports sole traders, unregistered and registered providers across Australia to successfully start, own and operate an individual and outcome-focused, engaged, and compliant disability service.
    2. Advice, mentoring, coaching, information, support, resources, training, and tools via internal & external software/ platforms including social media.

       

      Disability Compliance Aust. Pty Ltd may but not limited to cancel, change, update or discontinue the availability of services at any time at its sole discretion.

       

  4. PRODUCTS

    By placing an order or subscription, you are offering to purchase the product or service for the price advertised and indicated on the website at the time of purchase. Please check the prices and features before placing an order or subscription. When a service user places an order or subscription for a product or service, Disability Compliance Aust. Pty Ltd will send that service user an email whose purpose is to confirm the purchase and payment. This confirmation email will be produced automatically so that the service user has confirmation of their purchase and details. Once the payment process is completed, the product or service can be but not limited to being downloaded or booked by the user. Disability Compliance Aust. Pty Ltd may cancel any order and not supply products or services if it is reasonable to do so and may change or discontinue the availability of products or services at any time at its sole discretion. All new orders or subscription are considered separate, and each is treated individually.

     

    As a compliance and service user protection strategy, Disability Compliance Aust. Pty Ltd reserves the right to edit, update, remove and make unavailable offered products and/or services to ensure your ongoing compliance and provider obligation/s under all relevant legislation and laws. You agree that the edits, updates, removal, or unavailability of offered products and/or services is completely at the discretion of Disability Compliance Aust. Pty Ltd and may occur randomly, or as a planned event such as but not limited to template version updates. You accept and agree that you may have to re-purchase product/s and/or service/s at this time.

     

  5. MEMBERSHIP SUBCRIPTION

    Disability Compliance Aust. Pty Ltd offers the following memberships subscriptions:

     

    • Yearly Membership Subscription
    • Monthly Membership Subscription

     

    When a service user makes a purchase of a membership subscription, the service user agrees and declares to purchase the membership subscription for the price advertised on the website at the time of purchase. Please check the price and features of each membership subscription before ordering. When a service user makes a membership subscription purchase, Disability Compliance Aust. Pty Ltd will send a confirmation email. This confirmation email will occur automatically so that the service user has confirmation of payment and membership subscription initiation. If the service user does not receive the confirmation email when purchasing the membership subscription, it may have been sent to their spam folder. Disability Compliance Aust. Pty Ltd may cancel the sale of any membership subscription and may change or discontinue the availability of membership subscription at any time at its sole discretion.

    Disability Compliance Aust. Pty Ltd membership subscriptions are monthly and/or annual memberships and can be renewed on the initial purchase anniversary date. If a membership subscription purchase is cancelled by the user, any payments made before the cancellation date will not be refunded. This does not affect your statutory rights. You agree that Disability Compliance Aust. Pty Ltd has the sole discretion to refund payments or not after the cancellation date. Membership subscription may include automatic recurring payments. You authorize Disability Compliance Aust. Pty Ltd to renew your membership subscription and to charge you periodically and progressively on each billing date. The membership subscription billing date is the date you purchase the membership subscription and make your first payment. On the applicable billing date, you will automatically be charged the applicable membership subscription fee. The membership subscription will remain active until you cancel it, the payment fails, or we terminate it. You must cancel your membership subscription before it renews to avoid the next billing period. Membership subscription will not automatically renew annually or monthly. To cancel memberships subscription, users must submit a cancellation request via email to contact@disabilitycompliance.com.au and the membership subscription will be cancelled for the next billing period. If a membership subscription is cancelled, the user will be able to continue using the payment functions of the services until the next billing period, at which time the membership subscription will be cancelled definitively.

     

  6. PAYMENTS

    Services, subscription, products, and memberships subscription will be paid through Stripe (payment processors available on the website). Payment will be charged to your credit or debit card or debited from the user's account balance immediately after the corresponding payment for the subscription, products, or services. Upon processing a transaction, we will issue an electronic receipt that will be sent to the email address you provided to us at the time you purchased a membership subscription, purchase of services, or products. The email and transaction receipt may be sent through the payment processor available from Disability Compliance Aust. Pty Ltd. If you find any inconsistency in your billing, please contact us through our contact information or you can make the claim through the client service of the corresponding payment platform. If your card is declined, you will receive an error message. No payment will be charged to your card and no order will be processed. There may be a pending transaction on your account until your card issuing bank withdraws the authorisation. This usually takes 2 to 5 business days. Your card may be declined for various reasons such as insufficient funds, AVS (Address Verification System) mismatch or you have entered an incorrect security code. If your payment is declined, you must provide an alternative payment method or provide another card where payment can be charged and processed within 24hrs of the declined payment. Disability Compliance Aust. Pty Ltd memberships subscription are monthly or annual memberships. If your membership subscription payment is declined and you fail to contact us with new payment information within 24hrs, Disability Compliance Aust. Pty Ltd will issue you an invoice for payment on the outstanding payments on your membership subscription. The outstanding payment will be calculated per month from the date of the payment declined to the end date of the membership subscription. Your payment information will be treated and stored with total security and for the sole purpose of processing the purchase of services. Disability Compliance Aust. Pty Ltd reserves the right to hire any payment platform available on the market, which treats your data for the sole purpose of processing the purchase of services.

     

  7. DISCLAIMER

    By entering and using our website, use of any services including the purchase of any products and engaging with us on internal and/or external platforms that Disability Compliance Aust. Pty Ltd manages, you agree that Disability Compliance Aust. Pty Ltd does not guarantee any profits, results, success or failure provided by Disability Compliance Aust. Pty Ltd. Disability Compliance Aust. Pty Ltd is not responsible for any losses or benefits that our users may suffer or obtain that are directly or directly related to the provision of our website, services subscription and products. The user acknowledges that the ultimate success or failure of the website, services subscription and products provided by Disability Compliance Aust. Pty Ltd will be the result of each user's particular situation beyond the control of Disability Compliance Aust. Pty Ltd. By entering and using our website, use of any services including the purchase of any products and engaging with us on internal and/or external platforms you accept personal responsibility for the results of engaging and/or using the following but not limited to information, support, resources, training, tools, templates, and content available to you the user. Pty Ltd will immediately withdraw services, support, membership, product/s and more when but not limited to people and providers refuse to engage, participate commit to and review their own business or service operational management including the compliance with government & non-government legislation/law.

     

  8. THIRD-PARTY MATERIALS.

    “Third-Party Materials” means any content, images, videos, texts, or other material that is owned by a third party, such as stock images, videos and texts. Such Third-Party Materials are subject to the applicable third-party terms and licenses and may only be used as permitted by such terms and licenses.

     

  9. COPYRIGHT

    All materials including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, software, information, support, resources, training, tools, templates, content and other elements located on the website and internal and/or external platforms, are protected by copyrights, trademarks and/or other intellectual property rights owned and controlled by Disability Compliance Aust. Pty Ltd or by third parties that have licensed or otherwise provided their material to Disability Compliance Aust. Pty Ltd. You acknowledge and agree that all materials made available by Disability Compliance Aust. Pty Ltd is for limited, non-commercial, personal use only.     • Deep-link to any portion of the services for any purpose without our express written permission.
    • "Frame", "mirror" or otherwise incorporate any part of the services into any other websites or service without our prior written authorisation.
    • Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used or developed by Disability Compliance Aust. Pty Ltd.

Pty Ltd and Disability Compliance Aust. Pty Ltd shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

    • Any incorrect or inaccurate information on the website.
    • The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website or service purchased through the website.
    • Any loss or damage resulting from your use or the inability to use the website or resulting from unauthorised access to, or alteration of your transmissions or data in circumstances that are beyond our control.

  16. INDEMNIFICATION

    You agree to defend and indemnify Disability Compliance Aust. Pty Ltd from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

    • Your breach of this agreement or the documents referenced herein.
    • Your violation of any law or the rights of a third party.
    • Your use of the website, use of any services including the purchase of any products and engaging with us on internal and/or external platforms

     

  17. CHANGES AND TERMINATION

    We may change the accounts, platforms, programs, software, website, materials and these terms at any time, in our sole discretion and without notice to you. You are responsible for remaining knowledgeable about these terms. Your continued use of the site constitutes your acceptance of any changes to these terms and any changes will supersede all previous versions of the terms. Unless otherwise specified herein, all changes to these terms apply to all users take effect.     This agreement and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Disability Compliance Aust. Pty Ltd without restriction.

     

  19. INTEGRATION CLAUSE

    This agreement together with the privacy policy and any other legal notices published by Disability Compliance Aust. Pty Ltd, shall constitute the entire agreement between you and Disability Compliance Aust. Pty Ltd concerning and governs your use of the website and the services.

     

  20. DISPUTES

    The user agrees that any dispute, claim or controversy arising out of or relating to these terms and conditions, or the breach, termination, enforcement, interpretation or validity thereof or the use of the services, shall be resolved by binding arbitration between the user and Disability Compliance Aust. Pty Ltd, provided that each party retains the right to bring an individual action in a court of competent jurisdiction. In the event of a dispute arising in connection with the use of the services or the breach of these conditions, the parties agree to submit their dispute to arbitration resolution before a reputable arbitration organisation as mutually agreed by the parties and in accordance with applicable commercial arbitration rules. You agree to initiate a formal dispute proceeding by sending us a communication through our contact information. Disability Compliance Aust. Pty Ltd may choose to send you a written offer after receiving your initial communication. If we offer and send you a settlement offer and you do not accept the offer, or we are unable to resolve your dispute satisfactorily and you wish to continue with the dispute process, you must

     

    initiate the dispute resolution process before an accredited arbitration organisation and file a separate Demand for Arbitration. Any award rendered by the arbitration tribunal shall be final and conclusive on the parties. To the fullest extent permitted by law, you agree that you will not file, join or participate in any class action lawsuit in connection with any claim, dispute or controversy that may arise in connection with your use of the website and services. The courts of Australia shall have jurisdiction over any dispute, controversy or claim relating to Disability Compliance Aust. Pty Ltd and its business operations. Any such dispute or controversy shall be brought and resolved in the courts of Australia.

     

  21. FINAL PROVISIONS

    These terms and conditions are governed by the laws of Australia. Use of the website and services are not authorised in any jurisdiction that does not give effect to all of the provisions of these terms. Our performance of these terms is subject to existing laws and legal process, and nothing contained in these terms limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of our website or information provided to or gathered by us with respect to such use. If any part of these terms is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired. Our failure or delay in enforcing any provision of these terms at any time does not waive our right to enforce the same or any other provision(s) hereof in the future. Any rights not expressly granted herein are reserved.

     

  22. CANCELLATIONS/NO SHOWS

    Members of Disability Compliance Aust. Pty Ltd has the right to cancel their membership at any time

    by contacting our office on 1800 611 661 or in writing via email at contact@disabilitycompliance.com.au. You do not have to give notice in person. Please also refer to Section 5 – Memberships. Cancellations of consultations, bookings or appointments will require more than 48 hours’ notice from the scheduled date of the consultation, booking or appointment in writing via email at contact@disabilitycompliance.com.au.

     

  23. REFUNDS

    All refunds will be at the discretion of Disability Compliance Aust Pty Ltd. All services or products must be purchased within the last 30 days from Disability Compliance Aust Pty Ltd. If 30 days have passed since your service or product purchase, we will no longer be able to offer you a refund. All refunds will be paid in full via direct debit to a nominated account by the person/s involved. Refunds will be issued within 28 days to the person/s involved. To be eligible for a refund, we require a receipt or proof of purchase. Please note that sale items will not be refunded. Only regular-priced services or products may be refunded. We will not refund payments for cancellations or no-shows to consultations, bookings or appointments if you provide us less than 48 hours’ notice from the scheduled date of the consultation, booking or appointment in writing via email at contact@disabilitycompliance.com.au. For late or missing refunds, please contact your bank first than in writing to Disability Compliance Aust. Pty Ltd via our email at contact@disabilitycompliance.com.au.

     

  24. SERVICE USER RESPONSIBILITES

    Service users of Disability Compliance Aust Pty Ltd knowledges and accepts ultimate responsibility of but not limited to:

    • Your own engagement & actions needed to start, register or operate your own disability service.
    • Your own engagement & actions needed to prepare, update, understand, explain, comply with, change, submit and review all relevant legislation, practice standards and guidelines including your services applications, policies, procedures, forms, registered, plans, toolbox talks and so on.
    • Your own engagement & actions needed to accurately reflect how you will deliver services and supports as per your policies and procedures to all relevant key stakeholders.
