Disability Support Services Sector Inquiry

Have you experienced underpayment, non-payment or challenges in the disability support services sector? Come along to one of Fairwork’s open forum events where you can have your say about workplace compliance in the sector - Bunbury, Perth, Melbourne, Bendigo, Newcastle and Sydney. Fairwork’s is after your perspective on the needs of employers, employees and organisations in the sector, to hear what’s working and what needs improvement. These events are about workplace relations experiences only, such as pay, entitlements and employment conditions (not provider compliance under the NDIS, or enquiries or complaints about specific workplace disputes). If you’re unable to attend in person, you can still contribute to the Inquiry by email.

Right To Disconnect 

In short: It doesn’t mean you can’t be contacted outside your work hours. It does mean you can refuse out of hours contact, unless your refusal is unreasonable. You can choose not to monitor, read or respond to contact - work call, emails & messages. outside your working hours, unless refusing would be unreasonable. Reasonable will depend on your role, level of responsibility, industry and circumstances. It’s not unlawful for your employer to contact you out of hours. You can still be required to monitor, answer and respond to contact when you’re on call or working overtime. This means in disability to right to disconnect doesn’t really apply.
