WHAT IS DUTY OF CARE?
Duty of care is the responsibility of service providers (and the people who work in them) to ensure they do no harm to the people they support. But it doesn’t mean the service has to protect the person from themselves or the choices that person wishes to make.
WHAT IS DIGNITY OF RISK?
The concept of “Dignity of Risk” acknowledges every individual’s right to make choices about their life, even if those choices involve risk. Dignity of Risk empowers clients to make informed decisions while balancing safety, independence, and personal wellbeing in other words risks are identified and strategies are in place to manage them effectively, while respecting the client’s autonomy.
EXAMPLE
Tommy wants to learn to skateboard. Tommy has severe fine and gross motor limitations affecting his balance and centre of gravity. Tommy is obsessed and wants to skateboard.
You (as the provider) want to facilitate his dream. You meet and discuss the risks involved with Tommy and his mum. With consent, you contact his OT who is very concerned. You complete a mobility and skate park risk assessment which includes planning for health & emergency events. Tommy’ mum happily signs the documentation. All the staff have been trained in the support plan and risk assessments. Staff take Tommy to the skate shop and help him purchase leg + arm protectors, gloves and a fitted helmet as per the plans.
Oh no…bruises, scrapes and a broken arm is minor (in Tommy’s eyes) compared to the thrill of being free for a couple of hours. You as Tommy’s service provider has done EVERYTHING practically possible to balance the duty of care vs dignity of risk. We always should support dreams.
HOW TO IMPLEMENT DUTY OF CARE VS DIGNITY OF RISK INTO YOUR SERVICE?
For clients’ who wish to achieve their goals and aspirations despite a potential, perceived or actual risk to their safety or welfare (dignity of risk) you must fulfil your duty of care. Ways this can be achieved are by completing the following but not limited to:
- Key stakeholder Consultation & Collaborations
- Dignity of Risk Consent Form
- Risk Assessment Form/s (client & environment)
- Support Plan/s
- Supporting the client to access extra resources to complete the activity such as aids, equipment, information, training, modes of communication etc
