Mandatory Requirements for Restrictive Practice (RP)
 

Approved Restrictive Practices Reporting

When a behaviour support plan is lodged, the specialist behaviour support provider creates a list of the regulated restrictive practices and providers involved in the participants life. The  provider is required to report monthly on the use of restrictive practices. Reporting the use of a restrictive practice to the NDIS Quality and Safeguards Commission via the NDIS portal as per the following:

  • Once you have your PRODA account, login to the NDIS Commission Portal and request access for ‘Authorised Reporting Officer’ (ARO). This role is approved by the Authorised Access Delegate role within your organisation.
  • Monthly reporting must be completed for all regulated restrictive practices in a behaviour support plan, including reporting if they are not used. Monthly reporting should be completed within 5 business days of the following month.
  • Use an NDIS Quality and Safeguards Commission reporting template form to record the use of each restrictive practice and participant during the week. This is the employee’s responsibility to collect and record data into the recoding form and the manager to report to the NDIS Commission via the timetable above. 

 

Unapproved Restrictive Practice Approval and Reporting

Restrictive practice MUST only be used when approved. An approved Restrictive Practice has been appropriately authorised and is included in a detailed Positive Behaviour Support Plan or an authorisation and there is an authorisation process in relation to the use of the restrictive practice. Unauthorised restrictive practice may result from one of the following:

  • In an emergency
  • To save the person’s life
  • Risk of harm to self or others. 
  • Newly identified use of restrictive practice via the medication clarification of purpose form completed by the doctor/specialist.
  • The NDIS behaviour support practitioner many have not lodged a behaviour support plan to the Ndis Commission 

Unauthorised use of a Restrictive Practice is a Reportable Incident to the NDIS Commission. Report the unauthorised use of a restrictive practice to the NDIS Quality and Safeguards Commission via the telephone, email and NDIS Commission portal. You must implement the following timetable if there has been unauthorised use of restrictive practice:

  • Review & investigate the incident, risk assessments and other relevant documentation immediately.
  • Seek health & Medical assessment for the participant immediately
  • Notify the NDIS Commission of the Unapproved use of Restrictive Practice - within 24hrs
  • Commence NDIS Commission reporting requirements as per the NDIS Commission direction immediately.
  • Commence behavioural recording and tracking with the participant immediately.
  • Review participant funding, submit relevant forms and seek a behaviour practitioner – Within two days.
  • Implement, monitor, and review the Interim or full Behaviour Support Plan on completion by the Behavioural Practitioner 
  • If there has been the use of the unauthorised restrictive practice, immediately refer to the Reportable Incident Procedure.

 

Failure to report

Failure to report RP to the Ndis Commission may result in large fines. Currently 10 Ndis providers have been fined for failing to report to the commission, with the biggest fine being $145,680 as a result of 8 documents not being uploaded to the Ndis Commission Portal.
